Please read and understand the following terms and conditions before making a booking with Cupid's Trails.

Booking Terms and Conditions

Before submitting your Request to Reserve for your selected tour with Cupid's Trails, we urge you to read and understand the terms and conditions that apply to your booking.

When you submit your Request for Reservation, for your chosen tour, via the website cupidstrails.com ("the Website") you agree to the terms and conditions set out herein and in effect are entering into an agreement as provided herein.

This agreement shall be between you; the first named person / primary contact on the booking plus all persons on whose behalf this booking is made and the owner of the Cupid's Trails website; Xalt Ventures Pty Limited (ACN 673 983 189), (hereafter referred to as "XALT", "We", "Us", or "the Company"). Before making the booking, you must ensure that each traveller named in the booking is informed of these Terms and Conditions.

If you are a Traveler named in a booking made by a Primary Contact, you agree that the Primary Contact may amend or cancel the booking on your behalf and you will thereafter be bound by their actions, unless you notify us in writing that are not authorised to do so.

XALT sells tour packages ("Tour/s") including ancillary services such as travel, accommodation and other leisure activities but excluding airline tickets and/or air-travel related services. XALT is neither a common carrier nor a private carrier and does not provide any of the travel, accommodation or other activities described on this website ("Travel Products") that collectively make up a Tour. XALT acts as your agent in making the arrangements with third party suppliers who provide Travel Products as principals ("Suppliers"). XALT is not the agent of any such Supplier. You will however also be subject to the terms and conditions of any Supplier if presented to you in addition to these terms and conditions.

Registration

To make use of all features of the Website and purchase any Tours, you must register as a user. During registration you will be required to provide us with information about yourself including your name, email address, mailing address, phone number and a password. You agree to provide accurate complete and true information and keep such information current at all times. To maintain the security of your information and account, you are responsible for keeping your password confidential.

Your personal information, login and password may not be shared with or used by any other person. You are fully responsible for all activities that occur under your account username and password including but not limited to purchases, communications, and any other use of the Website. You should immediately notify us of any unauthorized use of your account username or password by emailing enquiries@cupidstrails.com.

We have no liability for unauthorized use of your account or password. If you provide personal information about another person, such as a travel partner, family member, or emergency contact, you must ensure that you have obtained their consent to share their personal information with us and that they are aware of our Privacy Policy.

You are responsible for reviewing the Privacy Policy as it may be updated from time to time and for informing yourself of any changes.

Capacity and Eligibility

By accessing and/or using the Website and making a booking, you represent and warrant that: (a) you are 18 years of age or older; (b) you are legally able to enter into binding contracts; (c) you are a resident of a country in which it is legal for you to access and use the Website; and (d) you are not legally or financially restricted from entering into agreements or conducting business online.

If you are making a booking on behalf of other persons, you represent that you have the legal authority to do so and that all information provided is accurate.

Changes to the Website

We reserve the right to modify, suspend, or discontinue the Website, or any services provided through it, at any time with or without notice. We may also restrict access to certain areas of the Website or to specific users. You agree that we will not be liable to you or any third party for any such modification, suspension or discontinuation of the Website or services.

If you have purchased a Tour prior to any such changes, you will still be entitled to receive the Tour as purchased.

Deposit Payment

Upon submission of a Request to Reserve (RTR), you are required to pay a deposit to secure your booking. The deposit is 30% of the total Tour price unless otherwise specified in our confirmation of your RTR or any special promotions we may be running. You will be required to pay the deposit within 48 hours of receiving a confirmation of RTR.

If your RTR is confirmed within 60 days of the Tour commencement date, the full Tour price is payable upfront at the time of booking.

Deposit amounts may vary for specific Tours and special campaigns and will be clearly indicated at the time of confirmation of RTR.

Deposits, where collected are used to ensure that all travel components of your Tour are secured in advance.

Confirmation Of Your RTR

If we approve your RTR, we will issue a confirmation of your RTR via email to the email address provided in your account. This confirmation will include: (a) details of the Tour selected; (b) the price locked in for your Tour (based on current rates or better); (c) the deposit amount required; and (d) payment instructions. Until the RTR is confirmed, it will show as ‘Pending Confirmation’ on the “My Tours” section of your Cupid’s Trails account.

Balance Payment

Once the deposit is received as cleared funds, we will issue you a Reservation Confirmation.

The outstanding balance of your Tour price (total price minus deposit) is due 45 days prior to your Tour commencement date, unless otherwise specified in your Reservation Confirmation.

Payment details and instructions will be provided in your Reservation Confirmation and reflected in your "My Tours" account section. When your balance payment is received, we will issue a Booking Confirmation.

If full payment is not received by the due date, we will send you a payment reminder. If payment is not received within 3 days of the reminder, your reservation may be cancelled at our discretion subject to applicable cancellation fees.

Pricing and Surcharges

Tour prices are based on current market conditions, currency exchange rates, fuel costs, demand, and seasonal fluctuations. Prices are subject to change at any time prior to us issuing your Booking Confirmation. Prices may vary for different customers booking the same Tour at different times, which is standard practice in the travel industry.

Once we have issued your Booking Confirmation including a locked-in price, that price will not change unless you request modifications to your Tour or a surcharge is applied in accordance with this clause.

If after receiving your RTR Confirmation, but before receiving your Booking Confirmation, we amend the pricing due to exchange rate or other changes, we will notify you. You then have 7 days to either: (a) accept the new price; or (b) cancel your booking for a full refund.

If you take no action within 7 days, you are deemed to have accepted the revised price.

We reserve the right to impose surcharges up to 60 days before departure if there are unfavorable changes in exchange rates, fuel surcharges imposed on suppliers, increases in transportation costs, or increases in government taxes, levies, permits or charges beyond our control.

We will absorb any surcharge increases up to 5% of your confirmed Tour price. Any surcharge exceeding 5% will be your responsibility. However, if any surcharge results in a total increase of more than 10% of the original confirmed Tour price, you may cancel your booking within 7 days of receiving notice of the surcharge and receive a full refund.

All prices are inclusive of all applicable taxes, levies, and government charges unless specifically stated otherwise.

Cancellation by You

You may cancel your Tour booking by providing written notice to enquiries@cupidstrails.com. A cancellation only becomes effective when we receive and acknowledge your written request to cancel.

  • If cancellation occurs 45 or more days prior to the Tour commencement date: Your deposit will be converted to a credit that you can use for any future Tour booking with us within 12 months of the original booking date. You may request a refund of this credit minus any cancellation charges that may apply.
  • If cancellation occurs 15-44 days prior to departure: A cancellation fee up to 30% of the total Tour booking price applies. The balance of any payments will be converted to a credit..
  • If cancellation occurs within 14 days of departure: A cancellation fee equal to 100% of the total Tour booking price applies. .

Unused services (accommodations, activities, meals other than hotel inclusions, guides) have no refund value once the Tour has commenced.

If you fail to join a Tour on the Tour commencement date, join after commencement, or leave before the Tour ends, the full Tour price remains due and no refunds will be provided for unused portions.

We strongly recommend that you purchase travel insurance at the time of booking your Tour to protect against potential losses from cancellation.

Your statutory rights under Australian Consumer Law may provide additional protections beyond these cancellation terms in certain circumstances.

Cancellation by Us

We reserve the right to cancel a Tour or your booking in the following circumstances: (a) if insufficient numbers of participants register for the Tour to make it economically viable (minimum numbers not met); (b) if unforeseen circumstances prevent us from delivering the Tour; or (c) if you breach these terms and conditions.

If we cancel a Tour due to insufficient numbers or operational reasons more than 45 days before departure, we will offer you: (a) an alternative Tour of similar value; or (b) a full refund of all payments made.

If cancellation occurs within 45 days of departure due to circumstances beyond our control, we will make our best efforts to arrange an alternative Tour or will offer a full refund, provided we have given you the maximum notice possible under the circumstances.

We are not responsible for any costs, losses, or damages you incur due to our cancellation of a Tour except as specifically provided herein.

Force Majeure

Force Majeure Events include but are not limited to: acts of God (earthquakes, floods, severe weather, volcanic activity); acts of war, terrorism, civil unrest, or government action; pandemics, epidemics, or public health emergencies; strikes; supply chain disruptions; airline failures; and any other events or circumstances beyond the reasonable control of both parties.

In the event of a Force Majeure Event that prevents us from delivering your Tour as booked, you may: (a) accept an alternative Tour of substantially similar quality and price; (b) accept a credit toward a future Tour; or (c) request a refund of payments made minus any unrecoverable costs incurred.Force Majeure Events do not relieve you of payment obligations if the Event occurs after full payment has been made and you choose not to proceed with the Tour, except where the Supplier fails to deliver services.

Your Use of the Website

You agree that your use of the Website is for lawful purposes only and that you will not: (a) use the Website to harass, abuse, or harm any person; (b) use the Website to transmit viruses, malicious code, or other harmful content; (c) attempt to gain unauthorized access to the Website or its systems; (d) scrape, data-mine, or extract content from the Website without authorization; (e) use the Website to send unsolicited marketing or spam; or (f) reverse engineer or attempt to discover the source code or underlying technology of the Website.

We reserve the right to terminate your access immediately if you violate any of these restrictions.

All information, descriptions, images, and content on the Website are provided for informational purposes only. While we endeavor to ensure that all information is accurate and current, we do not warrant that the information is free from errors or that it is suitable for any particular purpose.

The Website may contain links to third-party websites. We do not endorse or take responsibility for the accuracy or content of any third-party websites linked from our Website.

Tour descriptions, itineraries, pricing, and availability are subject to change without notice. Current information is always available on the Website.

Booking Confirmation and Access

Your booking confirmation will be issued via email and will also be accessible in your "My Tours" account section on the Website at any time.

It is your responsibility to ensure that you retain easy access to your booking confirmation and relevant Tour documentation.

You should download and retain a copy of your booking confirmation.

Non-Exchangeable and Non-Transferable

Your Tour booking is non-exchangeable and non-transferable. You cannot transfer your booking to another person or exchange it for a different Tour once it has been confirmed.

Any changes to your booking (such as name changes) must be approved in writing by us and may result in additional fees.

Booking Purchase Expiry

A booking confirmation is valid for the Tour commencement date specified. You cannot extend the use of your booking confirmation to a different date after it has been issued unless we agree in writing and any applicable price differences or change fees are paid.

Consecutive Days

Tour itineraries describe activities and accommodations for consecutive days starting from the Tour commencement date through the Tour end date. If you do not occupy accommodation on all nights, your entitlement to services on those days may be limited.

Changes to Tours By Us

We reserve the right to make minor changes to Tour itineraries, accommodation, included activities, or services without notice if necessary to meet operational, safety, or regulatory requirements.

Major changes to your Tour will be communicated to you as soon as practicable. Major changes include: (a) changes to Tour dates; (b) changes affecting more than one day of activities; (c) significantly different accommodation; or (d) significant price increases.

If we make a major change and you do not wish to proceed with the revised Tour, you then have 7 days to either: (a) accept the revised Tour; or (b) cancel your booking for a full refund.

If you take no action within 7 days, you are deemed to have accepted the revised Tour.

Changes to Your Booking By You

Changes to your booking (names, dates, Tour selection) must be requested in writing at: enquiries@cupidstrails.com

Change requests must be received at least 60 days prior to your Tour commencement date. Changes requested within 60 days may not be possible or may incur penalties depending on Supplier policies.

Any changes may result in price adjustments. If a change results in a higher price, you will be required to pay the difference. If the price is lower, no refund of the difference will be provided unless agreed otherwise.

Name changes are permitted to correct spelling errors or similar minor corrections only. Transferring a booking to a different person is not permitted.

Pricing and Invoice Errors

We endeavour to ensure that all pricing and invoice information is accurate. If an error is discovered in your invoice or pricing, we will notify you and provide a corrected invoice.If you have already paid based on an incorrect price and we issue a corrected invoice, you will have 7 days to either pay any additional amount owing or cancel your booking for a full refund.

If a correction results in a price reduction due to an error, the difference will be credited to your account.

What is Not Included in Your Tour

Unless explicitly stated in your Tour description as "Included in Price," the following are NOT included: international or domestic flights and airfare; travel insurance; personal travel insurance (medical, baggage, cancellation); vaccinations or health requirements; meals & beverages not listed as included; tips, gratuities, and service charges; laundry and personal services; activities not listed as included; transport not listed as included; activities undertaken independently; government taxes or entry fees to attractions not listed as included; travel guide books; spending money as part of a special promotion; and any other items not expressly listed as included.It is your responsibility to budget for these items and to ensure you have adequate funds beyond the Tour price.

Travel Insurance

Travel insurance is STRONGLY RECOMMENDED and should be purchased at the time of booking. Travel insurance typically covers: medical emergencies abroad; evacuation costs; cancellation protection; baggage loss or delay; and travel delays.

We do not provide travel insurance and are not responsible for any medical, legal, or financial costs incurred abroad. We may recommend travel insurance providers, but selection and purchase is entirely your responsibility.

Some Tours may include a travel insurance incentive. Details will be provided in the Tour description.

Passports, Visas, Vaccinations, Health, and Baggage

It is entirely your responsibility to: (a) ensure your passport is valid for at least 6 months beyond your planned Tour end date; (b) disclose any health conditions or mobility limitations; (c) comply with vaccination or health requirements; (d) pack adequate and appropriate baggage; and (e) comply with all customs and immigration laws.

We are not responsible if you are denied entry to any country, vaccination site, or service due to lack of required documentation, health condition, or non-compliance with country requirements.We are not responsible for baggage loss, damage, or delay. You should check baggage restrictions and potential loss coverage with each airline or service provider.

If you have disclosed health conditions or mobility limitations, we will do our best to accommodate you, but we cannot guarantee accessibility or suitability for all Tours.

If you fail to disclose health information that affects your safety or that of other participants, you assume all liability and we have no responsibility for outcomes.

Liability

Xalt Ventures Pty Ltd designs and arranges Tours, but does not directly provide or operate any of the services that make up the Tour. Services are provided by third-party suppliers (accommodations, transportation, activities, guides) who are independent suppliers and not our agents or employees.

To the fullest extent permitted by law, neither we nor any of our directors, officers, employees, or agents are liable for: (a) any injury, illness, death, or damage to any person; (b) loss, damage, or delay to baggage or property; (c) any financial loss, costs, or expenses; or (d) any other damage whatsoever, arising from or related to your Tour, whether caused by negligence of a Supplier, acts of third parties, events beyond our control, or any other cause.

This liability exclusion applies to the maximum extent permitted by law, except where Australian Consumer Law prohibits such exclusion. We do not assume any liability for the acts, omissions, defaults, or negligence of any Supplier or third-party providing services, including airlines, hotels, activity operators, ground handlers, guides, or government authorities.You are solely responsible for all costs, fines, legal fees, and other expenses arising from your violation of any law, regulation, customs requirement, or entry requirement of any country.

Limitation of Liability

We do not accept any liability or responsibility for: (a) breach of Supplier contracts or Supplier negligence; (b) any claim arising from the acts or omissions of a Supplier or third party; or (c) any terms and conditions of any Supplier that you agree to.

You agree to indemnify and hold us harmless from any claim, damage, or liability arising from Supplier actions, your violation of Supplier Terms, or any loss caused by a Supplier. This indemnification does not apply if we have breached these Terms in a material way.

Indemnity

You agree to fully indemnify, defend, and hold harmless us, our directors, officers, employees, agents, and successors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of any law or regulation; (c) your use of the Website contrary to these Terms; (d) your participation in the Tour; or (e) any claim by a third party arising from your acts, omissions, or conduct.

This indemnity obligation survives termination of your booking or these Terms.

Third-Party Website Links and Content

The Website may contain links to other websites. We do not search, monitor, or endorse any third-party websites and are not responsible for their content, accuracy, or functionality.

Third-party websites are operated independently and may have their own terms, conditions, and privacy policies. Your use of third-party websites is at your own risk and entirely your responsibility.

Third-party content linked to our Website (such as reviews, comments, or recommendations) reflects the opinions of third parties only and does not represent our endorsement or approval.

Complaints and Dispute Resolution

If a problem occurs during your Tour, the best path to resolution is to contact your Tour Custodian or Supplier immediately and attempt to resolve the issue in real time.

You should keep your Tour Contact (provided in your booking confirmation) informed of any issues that arise.If an issue is not resolved on-site, submit your complaint in writing to enquiries@cupidstrails.com within 30 days of returning to your home country. Include: (a) details of the issue; (b) which Supplier was involved; (c) the date the issue occurred; (d) your efforts to resolve it; and (e) supporting documentation or evidence.

We will investigate your complaint and respond within 14 days. If we agree that compensation is warranted, refund or credit will be provided in accordance with our cancellation and refund policies.

If you do not lodge a complaint in writing within 30 days of return, we may deny your claim.

Intellectual Property

All content on the Website including text, graphics, logos, images, audio, and video (collectively "Content") are the exclusive intellectual property of Xalt Ventures Pty Ltd or our licensors. All Content is protected by copyright, trademark, and other intellectual property laws.

You may view and download Content for your personal, non-commercial use only. You may not modify, publish, transmit, transfer, sell, reproduce, create derivative works from, distribute, or in any way exploit any Content without our express written permission.

If you correspond with us or provide feedback, suggestions, or ideas regarding our Website or Tours, you grant us an irrevocable, worldwide, royalty-free license to use your correspondence and ideas for any purpose including improving our service and creating marketing materials.

Any testimonials or reviews you provide may be published on our Website or in marketing materials.

Changes to These Terms and Communications

We reserve the right to modify these Terms at any time. Changes will be posted on the Website and your continued use of the Website after changes are posted constitutes acceptance of the modified Terms.

If there are material changes to these Terms that negatively impact your existing booking, we will notify you by email. You will have 7 days to either: (a) accept the changes; or (b) cancel your booking for a full refund.If you take no action within 7 days, you are deemed to have accepted the revised price.

We collect and use personal information in accordance with our Privacy Policy. By using the Website, you consent to our collection and use of your personal information as described in our Privacy Policy.

We may send you administrative emails (account activity, order details, customer support) and promotional emails (product offers, new Tours). You may opt out of promotional emails by replying "unsubscribe" to any promotional email.

Governing Law and Jurisdiction

These Terms and Conditions and your use of the Website and Tours are governed by and interpreted in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law principles.

You irrevocably submit to the exclusive jurisdiction of the courts of the State of Victoria and the Australian courts for the resolution of any dispute arising from these Terms or your Tour booking.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

Definitions

Request for Reservation (RTR)The first step of your booking process where you submit your Tour selection for us to verify your request on a first come first served basis.
Confirmation of RTR The confirmation we will issue in any form of communications such as an email, web account update or text (or a combination of any of these communication forms) within 24 - 48 hours upon receipt of your RTR.
Confirmation of ReservationThe confirmation we will issue in any form of communications such as an email, web account update or text (or a combination of any of these communication forms) within 24 - 48 hours upon receipt of your Deposit.
Booking ConfirmationThe confirmation we will issue in any form of communications such as an email, web account update or text (or a combination of any of these communication forms) within 24 hours upon receipt of your Full Payment.
